§1 General provisions
1. electricgatespares.com online store, operating at http://www.electricgatespares.com, is operated by PLUSCOM S.C. with its registered seat in Jaworzno (43-600), Grunwaldzka 252a Street (Warehouse), entered in the Central Register and Information on Business Activity conducted by the Minister of Economy of the Republic of Poland, NIP: 632-187-87-55, REGON 278352568 hereinafter referred to as the Store.

2. The party making purchases in the Store is an adult natural person, legal entity or organizational unit without legal personality, hereinafter referred to as the Customer.
3. These Regulations are an integral part of the contract of sale of the products offered.
§2 Subject matter and ordering goods
1. The subject of sale are the products presented on the pages of the Store. Information about the goods is an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
2. Products available in the Store are brand new, free from physical and legal defects and have been legally introduced into the Polish market. However, the Seller reserves the right to offer sale and used products, which will be appropriately marked and described.
3. Prices quoted in the Store are both in net values and with VAT in the value resulting from applicable laws. Prices are given in Polish Zloty and Euro. These prices do not include shipping costs. Information about the total cost of the order is given before confirming the purchase on the Store's website at http://www.electricgatespares.com/koszyk.html.
4. The forms of delivery, their cost and forms of payment offered by the Store depend on the specifics of the goods and the country of delivery and are listed on the Store's website at http://www.electricgatespares.com/koszyk.html. Shipping costs are covered by the Customer. Payment can be made in the form of prepayment to a bank account, through PayPal, cash at the premises of the entrepreneur or cash, upon receipt of the shipment from the forwarder. Payment in cash at the forwarder is possible only when the country of delivery is Poland. If you choose to pay via PayPal, the Store will add a fee for making the payment in the amount of the transaction costs incurred.
5. In order to place an order, the Customer is required to select the ordered goods, delivery method, delivery address and payment method.
6. The Customer, by confirming the purchase in the Store, makes an offer to conclude a contract of sale of the ordered goods with the Store. At the time of confirming the purchase, the Store sends an order specification to the Customer at the e-mail address provided. The specification does not constitute confirmation of acceptance of the order for execution. Confirmation of acceptance of the order for processing will be sent to the e-mail address immediately after the Store verifies the availability of the goods, constituting a statement of acceptance of the offer. Payments made by the Customer, with the exception of payment made upon receipt of the order, until the Store sends confirmation of acceptance of the order for processing, constitute a prepayment for order processing.
7. The customer is obliged to pay the price for the products ordered in the Store, including delivery costs, no later than 14 days from the date of conclusion of the contract, subject to when payment is made on delivery.
8. The Store places great emphasis on fast picking and delivery of products. Typical orders for products available in the Store's warehouse are fulfilled no later than the next working day after the order is placed, provided that payment in the form of prepayment has been credited to the Store's account. In case of unavailability of the ordered product or products, the time of completion and delivery will not exceed 14 working days.
9. Placing an order is tantamount to consent to the storage and processing by electricgatespares.com company of personal data contained in the order, in accordance with applicable provisions of the Act on Personal Data Protection, Journal of Laws No. 133 item 883.
§3 Payment
1. Prices in the Store are quoted in EUR.
2. the costs associated with the delivery of the Goods (e.g. transport, delivery, postal services) and any other costs shall be borne by the Customer. The amount of these costs may depend on the Customer's choice as to the method of delivery of the Goods. Information on the amount of these costs is provided at the stage of placing the Order.
3. The Customer may choose the form of payment:
- traditional transfer - payment before dispatch of the Goods (prepayment). After placing the Order, the Customer should pay/pay the amount due to the bank account of the Store. The Order is fulfilled after the Customer's payment is credited to the Store's bank account;
- payment via the Przelewy24 payment system - payment before shipment of the Goods (prepayment). After placing an Order, the Customer should make payment via the Przelewy24 payment system. The Order is realised after the Customer's payment is recorded in the Przelewy24 payment system;
- payment via the Paypal payment system - payment before shipment of the Goods (prepayment). After the Order has been placed, the Customer should pay via the Paypal payment system. The Order is realised once the Customer's payment has been credited to the Paypal payment system;
4. The Parties may agree payment by deferred payment invoice. For each Product sold, the Store issues a proof of purchase and delivers it to the Customer, insofar as the provisions of common law require delivery.
§4 Complaints and warranties
1. Products may have a manufacturer's or importer's warranty. The period and detailed conditions of the warranty are placed in the specifications on the product card in the Store.
2. The Store shall be liable for product defects under applicable law. In the case of non-consumer sales, the warranty provisions of the Civil Code are excluded.
3. In accordance with the Law of May 30, 2014 on consumer rights, the Customer who is a Consumer, may withdraw in writing from the contract without giving any reason within 14 days from the date of delivery of the item, understood as taking possession of the item by the consumer or a third party other than the carrier designated by the consumer. To make a declaration of withdrawal, the Consumer should submit a declaration of withdrawal to the address of the Store and return the goods to the Store, no later than 14 days from the date of the declaration.
4. Returned goods must be complete. Goods should be returned unaltered unless the change was necessary within the limits of ordinary management.
5. The consumer shall be liable for any diminution in the value of the item resulting from the use of the item beyond what is necessary to ascertain the nature, characteristics and functioning of the item.
6. The right of the Consumer to withdraw from the contract shall not apply in the case:
- in which the subject of performance is a thing which, after delivery, by its nature, is inseparably combined with other things,
- in which the subject of performance is a non-refabricated thing, produced to the consumer's specifications or serving to meet his individualized needs
7. The store shall refund the returned goods within 14 (fourteen) days.
8. The consumer shall bear the direct costs of returning the item to the Store.
